Civil monetary penalty (CMP)
A civil monetary penalty is a fine OIG can impose for prohibited conduct in federal health care programs, including billing for items or services furnished by a person on the LEIE. It is set per item or service, plus an assessment.
What to know
- For contracting with or employing a person on the LEIE, the penalty is up to $20,000 per item or service in the statute, adjusted for inflation each year: $25,595 for 2025.
- OIG can add an assessment of up to three times the amount claimed for each item or service, or of up to three times the total cost of the person where their work is not billed separately.
- Penalties are a maximum, not a set amount: OIG weighs factors such as how long the arrangement lasted and whether the organization disclosed it.
