Overpayment (60-day rule)
An overpayment is money a provider received from Medicare or Medicaid that it was not entitled to keep. Once identified, it must be reported and returned within 60 days, or by the related cost report’s due date if later.
What to know
- Payment for items or services furnished by a person on the LEIE is generally an overpayment.
- Keeping a known overpayment past the deadline can create liability under the False Claims Act.
- The rule looks back six years, so screening records from earlier years can matter.
