Stark Law

The Stark Law stops physicians from referring Medicare patients for certain health services to entities they, or an immediate family member, have a financial relationship with, unless an exception applies.

What to know

  • It is a civil, strict-liability law: intent does not matter, and claims from a prohibited referral must not be billed.
  • It is separate from the Anti-Kickback Statute, which applies to anyone and requires intent.
